    Ningbo Maritime Court Accepted the First Case in China in Which Foreign Entity Applied for Constitut

    Recently, Ningbo Maritime rendered a ruling in accordance with the International Convention on Civil Liability for Oil Pollution Damage, 1992 as well as legal provisions in Chinese law, granting an application submitted by a Panama company for constitution of limitation fund for maritime claim of oil pollution damage, with the amount of the fund as 6743109 SDR, equivalent to RMB55 million. It is learnt that this is the first case in which foreign entity was granted to constitute such limitation fund in China.

    Shanghai Maritime Ascertained the Exact Period of Detention at Court Based on Vessels Big Data

    Due to provisional changes of places and time of loading, a vessel responsible for transportation was detained at a port for certain period. The logistics company thus claimed losses against shipper, whilst the shipper lodged objection to the place and time as specified on deck logbook for which the vessel was detained. Recently, in a case of dispute arising from voyage charter party, Shanghai Maritime Court checked out the sailing dynamic status of the vessel through the “vessel data analytic system” developed by its own, ascertaining effectively the period of detention, and result of which was finally confirmed by parties concerned, promoting the conciliation of the case in court.

    Northeast Asian International Shipping Centre Arbitration Forum Held in Dalian

    Northeast Asian International Shipping Centre arbitration forum was held in Dalian Bangchui Island Hotel recently. This forum was co-hosted by Liaoning Port Group, Dalian Arbitration Committee and Law School of Dalian Maritime University, coordinated by Dalian Law Society and Law School of Shanghai Maritime University. Over 150 scholars, professors and representatives from fields of law, arbitration and enterprises attended the forum. Deputy Mayor Zhang Zhihong as well as persons in charge in Dalian Maritime University and Justice Department of Liaoning Province also attended the forum and made speeches.
