Announcement on Matters Relating to Complete Prohibition of Import of Solid Waste

The Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste was amended and adopted by the 17th meeting of the 13th Standing Committee of the National People’s Congress on April 29, 2020, and will come into effect on September 1, 2020. In order to implement the revised contents concerning the import management of solid waste in the Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste and do a good job in linking up relevant work, it is hereby announced relevant matters as follows:

 

I.                   The import of solid waste by any means is prohibited. It is forbidden for solid waste from outside China to be dumped, piled up and disposed on in China.

II.                The Ministry of Ecology and Environment shall stop accepting and approving applications for import licenses on solid wastes (import of which is under restriction) that can be used as raw materials; The import license for solid wastes (import of which is under restriction) that can be used as raw materials issued in 2020 shall be used within the validity period of 2020 specified in the certificate and shall expire automatically after the expiration date.

III.             Solid wastes generated by units in special customs supervision areas and bonded supervision places (including bonded areas, comprehensive bonded areas and other special customs supervision areas, bonded logistics centers (Type A/B), bonded warehouses and other bonded supervision places) that have not been re-transported out of China shall be managed in accordance with relevant provisions on domestic solid wastes. If the same needs to be stored, utilized or disposed of outside aforesaid areas, relevant formalities shall be handled with administrative departments of the local government of the special customs supervision area and the bonded supervision area, and Customs shall no longer check the relevant approval documents.

IV.             In respect of solid wastes not transported out of China generated in the course of production and operation by bonded maintenance and remanufacturing units outside special customs supervision areas and bonded supervision places, implementing with reference to the provisions of paragraph 3.

 

This Announcement shall come into implementation as of January 1, 2021.The Notice on Strengthening the Management of Solid Waste Import and Sharing of Law Enforcement Information(HB [2011] No.141) issued by ex-Ministry of Environment Protection, General Administration of Customs as well as ex-CQSIQ, the Announcement (2015) No.69 issued by ex-Ministry of Environment Protection, the National Development and Reform Commission, the Ministry of Commerce, the General Administration of Customs and the ex-CQSIQ, the Announcement (2017) No.39 issued by ex-Ministry of Environment Protection, the Ministry of Commerce, the National Development and Reform Commission, the General Administration of Customs and the ex-CQSIQ, the Announcement (2018) No.6 issued by the Ministry of Ecology and Environment, the Ministry of Commerce, the National Development and Reform Commission and the General Administration of Customs, as well as the Announcement (2018) No.68 issued by the Ministry of Ecology and Environment, the Ministry of Commerce, the National Development and Reform Commission and the General Administration of Customs shall be concurrently annulled.
